These Terms of Use (“Terms” or “Terms and Conditions”) govern your use of and access to the websites located at www.primalhomesolutions.com and any related subdomains or online platforms operated by Primal Residential Properties, LLC (“Primal Vacation Rental Management,” “Primal Home Solutions,” “we,” “our,” or “us”), as well as any materials, information, or services provided on or through the Site (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our [Privacy Policy], which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and disclose the information you provide to us. If you do not agree to these Terms or the Privacy Policy, you may not use our Services.
These Terms include important provisions affecting your legal rights, including:
A waiver of your right to participate in a class or representative action, and
An agreement that any disputes between you and Primal Residential Properties, LLC will be resolved by binding arbitration, except as otherwise stated in the Dispute Resolution section below.
If you do not wish to be bound by these Terms, you must discontinue use of our Services immediately.
Modifications to These Terms
We may modify these Terms of Use from time to time at our sole discretion. If we make material changes, we will provide reasonable notice of such changes—such as updating the “Effective Date” at the top of this page or providing notice through the Services. The materials are for internal, non-commercial use only, and
Any copies of materials or portions thereof include the copyright notice specified on the Services.
If attribution to Primal Home Solutions is included, limited quotations from the content are permitted. However, you may not copy, display, or redistribute any portion of the Site’s content for commercial purposes without our prior written permission.
Documents, images, and materials posted by Primal Home Solutions on the Site may contain additional proprietary notices or describe products, services, processes, or technologies owned by Primal Home Solutions or third parties. The Primal Home Solutions and Primal Vacation Rental Management names, logos, and all related product and service names, design marks, and slogans are trademarks, service marks, or registered trademarks of Primal Residential Properties, LLC (“Primal Home Solutions”). These marks may not be used in any manner—whether in advertising, publicity, or otherwise—without the prior written consent of Primal Home Solutions.

5. Disclaimer of Warranties and Limitation of Liability
5.1 Limitation of Liability
By using this Site, you assume all responsibility and risk associated with its use and with the Internet generally. It is your own original content or you have obtained all necessary rights and permissions to submit it; and

Unlawful, harmful, threatening, abusive, harassing, defamatory, or discriminatory;
Hate speech, sexually explicit, pornographic, or violent material;
Impersonating another person or entity;
Personal information about others posted without consent;
Spam, commercial solicitations, or promotional materials; or
Malware, viruses, or other harmful code.
Primal Home Solutions reserves the right to monitor, remove, refuse, edit, or take legal action regarding any User Content at its sole discretion. While we may review User Content, we are not obligated to do so and assume no responsibility for content posted by users. Users may report violations at Legal@primalhomesolutions.com.
6.3 Restrictions on Your Use of the Services
You agree to use the Services only for lawful purposes and in compliance with these Terms. You may not use the Services to:

Impersonate others or misrepresent yourself, your age, or affiliations;
Violate any national, state, local, or international law;
Promote criminal or illegal activity or provide instructions for such activities;

Use the Services for commercial purposes other than approved transactions through the Services;

6.4 Age Restrictions
You must be at least 18 years old (or the age of majority in your jurisdiction if higher) to create an account or use our Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
6.5 Governing Law
These Terms and your use of the Services are governed by the laws of North Carolina, United States of America, without regard to conflict of law provisions. Any legal action not subject to arbitration must be filed exclusively in state or federal courts located in North Carolina, and you consent to the personal jurisdiction of such courts.
6.6 Dispute Resolution
Informal Resolution
Before filing any claim, you agree to attempt informal resolution by contacting Legal@primalhomesolutions.com with your full name, email, telephone number, and a detailed description of the dispute. If unresolved within 60 days, formal claims may be filed. Claims filed prior to the end of the 60-day period are subject to dismissal.
Binding Arbitration
Unresolved disputes will be resolved through binding arbitration administered by JAMS under JAMS Streamlined Arbitration Rules. Key points include:
Arbitration is individual only; class or representative claims are waived.
Exceptions: intellectual property disputes or small claims within jurisdictional limits.
Opt-Out: You may reject arbitration within 30 days of first use or notice of material amendment by emailing Legal@primalhomesolutions.com with your details.
Arbitration Procedures
Arbitration follows the Federal Arbitration Act, preempting inconsistent state law.
Consolidation rules apply if ten or more claims arise with similar facts.
Arbitrator decisions for claims over $5,000 must include essential findings and comply with the Limitation of Liability section.
Awards apply only to the individual party seeking relief and do not affect others.
Delegation to Arbitrator
The arbitrator has exclusive authority to determine the enforceability of these Terms and any claim under them, except provisional remedies may be sought in court.
Waiver of Class or Representative Actions
You waive the right to court trials (except small claims or IP disputes) or participation in class, representative, or private attorney general actions.
7. Notice
You consent to receive any agreements, notices, disclosures, and other communications (collectively, “Notices”) referenced in these Terms electronically, including by email or posting on the Services.
You agree that all Notices provided electronically satisfy any legal requirement that such communications be in writing.
To withdraw consent to electronic Notices, email Legal@primalhomesolutions.com and discontinue use of the Services. In such a case, all rights granted under these Terms automatically terminate.
This consent is separate from marketing communications; your options regarding marketing are outlined in our Privacy Policy.
8. Changes and Updates
Primal Home Solutions reserves the right to modify, update, or discontinue any aspect of the Services or these Terms at any time, with or without notice.
We will endeavor to provide reasonable notice of material changes, such as updating the effective date or posting a notice on the Services.
Access to specific areas of the Services may be subject to additional or different terms.
Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
9. General
These Terms constitute the complete and exclusive agreement between you and Primal Home Solutions regarding the Services, superseding all prior agreements, communications, or proposals, whether written or oral.
Nothing in these Terms creates an agency, partnership, or joint venture relationship.
Our failure to enforce any provision shall not constitute a waiver of our right to enforce it later.
If any provision is found unenforceable or invalid, the remainder of the Terms shall remain in effect. Where possible, the provision will be modified to reflect the original intent.
Headings are for convenience and shall not affect interpretation.
Rights conferred are cumulative and may be exercised singly or together.
10. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent; any attempt to do so is void.
Primal Home Solutions may assign its rights and obligations to any successor or assignee.
11. Security
You agree to comply with any security procedures established by Primal Home Solutions, including password protection.
You may not access restricted areas of the Services without explicit written authorization.
Any unauthorized attempt to access areas of the Services may result in termination of access and potential legal action.
12. Indemnification
You agree to indemnify, defend, and hold harmless Primal Home Solutions, its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of:
Your use of the Services;
Your violation of these Terms;
Your User Content; or
Your violation of any law or the rights of a third party.
This indemnification obligation applies even if the claims are based on negligence, strict liability, or other legal theories.
13. Limitation of Liability
To the maximum extent permitted by law, Primal Home Solutions and its affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the Services, even if advised of the possibility of such damages.

14. Governing Law & Dispute Resolution
These Terms are governed by North Carolina law, without regard to conflicts of law provisions.
Any dispute not subject to arbitration must be filed exclusively in state or federal courts in North Carolina.
